In order to participate in Families for Families volunteer activities and all related activities, including any activities incidental to such participation (“Volunteer Activities”), the undersigned Volunteer or Parent/Legal Guardian of Volunteer if Volunteer is under age 18 (hereafter referred to using “I”, “me”, “my”, or “volunteer”) releases and agrees not to sue Families for Families or its officers, directors, employees, sub-contractors, sponsors, agents and affiliates (“the Foundation”) from all present and future claims that may be made by me, my family, estate, heirs, or assigns for property damage, personal injury, or wrongful death arising as a result of my participation in the Volunteer Activities wherever, whenever, or however the same may occur.
I understand and agree that Families for Families is not responsible for any injury or property damage arising out of the Volunteer Activities, even if caused by their ordinary negligence or otherwise.
I understand that participation in Volunteer Activities involves certain risks, including, but not limited to, serious injury and death. I am voluntarily participating in the Volunteer Activities with knowledge of the danger involved and I agree to accept all risks of participation.
I also agree to indemnify and hold harmless Families for Families for all claims arising out of my participation in the Volunteer Activities.
I understand that this document is intended to be as broad and inclusive as permitted by the laws of the state in which the Volunteer Activities take place and agree that if any portion of this Agreement is invalid, the remainder will continue in full legal force and effect.
I also acknowledge that Families for Families has not arranged and does not carry any insurance of any kind for my benefit or that of Volunteer (if Volunteer is under 18), my parents, guardians, trustees, heirs, executors, administrators, successors, and assigns.
I represent that, to my knowledge, I am in good health and suffer no physical impairment that would or should prevent my participation in Volunteer Activities.
I also understand that this document is a contract that grants certain rights to and eliminates the liability of Families for Families.
Volunteer Agreement and Waiver and Release:
Minors Please Note: If the volunteer is under 18 years of age, a parent/guardian must sign this Agreement.
I agree that I, or my child if under 18, (all referred to as “Volunteer”) may volunteer services to Families for Families in accordance with the following understandings:
1. The volunteer will offer their services with no expectation of pay, benefits, or other privileges of employment of any kind. I certify that the volunteer has not been promised and has no expectation that they will receive a paid position as a result of any volunteer work.
2. The volunteer agrees to follow the directions of Families for Families staff and to exercise reasonable care in all activities in which they participate.
3. I understand that despite careful preparation and instruction, not all hazards can be foreseen. I agree that I am solely responsible for determining if the volunteer is physically fit and/or properly skilled for any volunteer activity. I understand that I always have the right to refuse to allow the volunteer to participate in any task that I am uncomfortable with. I agree to waive, release and hold Families for Families harmless from all tort and civil liability arising from or relating to the volunteer services. This Agreement to waive, release and hold harmless includes not just Families for Families, but also its officers, employees, agents and independent contractors.
4. I understand and agree that Families for Families is not responsible for any of the volunteer’s personal property that is lost, damaged, or stolen while they are participating as a volunteer.
5. I grant Families for Families, all sponsors, affiliates, parties permitting use of property, coordinating groups, volunteers, and any individuals associated with the activity, permission to use the volunteer’s photograph or image with or without their name, both single and in conjunction with other persons or objects for any and all purposes, including, but not limited to, private or public presentations, advertising, publicity, and promotions relating thereto.
6. In the event of a medical emergency, I hereby give my consent for 1) transfer to the nearest hospital reasonably accessible; 2) the administration of any treatment deemed necessary by a licensed physician or dentist. This authorization does not cover major surgery, unless the medical opinions of two licensed physicians or dentists, concurring in the necessity for such surgery, are obtained prior to the performance of such surgery.
7. In consideration of being permitted to participate in the volunteer activity, I hereby, for myself, my child, and our executors, administrators and assignees, assume all risks and hold Families for Families, all sponsors, affiliates, parties permitting use of property, coordinating groups, volunteers, and any individuals associated with the activity harmless from any and all liability, causes of action, debts, claims, damages, or demands of any nature whatsoever which may arise in connection with my participation in activities.
8. MINOR VOLUNTEERS (12 – 17 years old): I hereby give my consent for my dependent to travel in another volunteer’s car or the Families for Families truck to offsite locations as the volunteer activity may necessitate. Travel may include the city of Paterson and other parts of Bergen & Passaic Counties. I hereby, for myself, my child, and our executors, administrators and assignees, assume all risks and hold Families for Families, all sponsors, affiliates, parties permitting use of property, coordinating groups, volunteers, and any individuals associated with the activity harmless from any and all liability, causes of action, debts, claims, damages, or demands of any nature whatsoever which may arise in connection with travel to and completing activities at offsite locations.
9. This Agreement shall be governed and construed in accordance with the laws of New Jersey, without regard to New Jersey’s conflicts-of-law principles, and all claims relating to or arising out of this contract, or the breach thereof, whether sounding in contract, tort or otherwise, shall likewise be governed by the laws of New Jersey, without regard to New Jersey’s conflicts-of-law principles. Any claims, legal proceeding or litigation arising in connection with this Agreement will be brought solely in Bergen County New Jersey, and the Parties consent to the jurisdiction of such courts.
